摘　　要：基于船舶管理和船舶管理人的法律含义、我国船舶管理业和调整船舶管理业的法律现状的介绍,分析和论述了我国船舶管理业务市场准入制度,船舶管理人的法律地位及其与政府主管部门、委托人和第三者的法律关系,以及船舶管理人可能承担的行政责任和民事责任,并提出了完善我国调整船舶管理业的法律和船舶管理人减少经营责任风险的建议。Based upon the introduction to the legal meaning of ship management and ship manager, the ship management industry in China and the current Chinese law regulating thereof, this paper discusses the legal system of entrance into ship management market, the legal status of ship manager and its legal relations with governmental authorities, its trustor and third parties, the disciplinary sanctions and civil liabilities the ship manager may incur and puts forwards suggestions for improving the law regulating the ship management issues in China and for decreasing the risks of its legal liabilities of ship manager.
