摘　　要：对船员人身伤亡赔偿的责任基础进行探讨,认为在民事责任竞和的情况下,船员可以选择行使请求权,同时建议在我国的船员立法中,应当确立船员人身伤亡侵权损害赔偿的无过错责任制。This paper discusses the liability of crews claim for casualty of life, and considers that the crew may choose the right of claim when civil liability concurrent. Then it suggests establishing a system of no-fault liability in the tort action of casualty of life during the crews lawmaking. [
