我国监狱实行开放式处遇制度的理性思考

摘　　要：开放式处遇是指在不影响刑罚执行的情况下,通过取消监狱围墙、铁栅栏、手铐等形式,减少对犯人自由的限制,增加对犯人的信任,以尽可能缩短在押犯同正常社会生活的距离。实行开放式处遇在我国具有必要性与可行性。我国可以采用劳动释放制、学习释放制、归假制等开放式处遇形态。The author talked about the general situation of the opening management system, set forth the necessity or feasibility which carrying out the opening management system in our country, and pointed out the concrete measures which carrying out the opening management system, namely labor-release system, learning-release system, back home system etc.
