工程建设安全管理中施工合同有关各方的职责

摘　　要：工程建设安全管理在工程实施过程中十分重要。本文介绍了ILO、BSI、AIHA制定的有关职业健康安全管理导则、我国相关的法律以及当前安全生产的形势 ,然后根据我国相关的法律、法规中的有关规定以及国际上权威性工程咨询组织 (FIDIC ,ICE ,AIA)编制的合同条件范本中的论述 ,对承包商、业主和监理工程师在安全管理中的职责和法律责任进行了详细的讨论。对国内某些工程安全事故的处理发表了笔者的观点和评论。Safety is one of the major concerns in the construction process.Starting with a brief introduction to the safety guidelines prepared by ILO, BSI and AIHA, China's legal framework relating to safety and the current situation of safety in construction, then based on China's legal provisions and those specified by international organizations in their model forms for conditions of contract, this paper provides a detailed discussion of the respective obligations and liabilities of parties involved in the construction process.Finally, the authors also present their views and comments on the verdict of one legal case concerning safety liabilities.
