摘　　要：古代音乐与以规制礼俗秩序的法律一脉相承 ,理解音乐的发展史有助于理解法律的发展史 ,音乐的审美结构和技术发展型塑了法律的语言结构和节韵 ,法律成为保护音乐著作者权利的理性护身符 ,中西音乐的不同特性为我们正确对待西学东渐的法律 。This author holds that the ancient music is the product of the state and the emperor's governing law. To comprehend musical history is beneficial to the comprehension of the development history of law, and the beautifully stanzaed and sensitively techniqued music types the law's language construction. The law reasonably affords to protect the author's copyrights of the music. From the comparison of the characteristics between the western society and China, the author believes that it is of great importance to serious treating in learning from the western laws and reasonable construction of the Chinese rule of law.
