人口老龄化背景下养老机构的法律风险研究

摘　　要：面对人口老龄化的背景,养老机构越来越成为人们养老的选择。按照与养老机构相关的法律法规,养老机构一般可以按照出资主体的不同划分为公办公营型的养老机构、公办私营型的养老机构、私办私营型的养老机构这样三种不同类型的养老机构。养老机构目前面临着内部与外部两层的法律风险,应当通过树立正确的认识、科学合理布局养老机构、建立合理的养老机构社会资源协调机制来预防当前养老机构的法律风险。In the face of the background of aging population, pension institutions have increasingly become people’s choice for the elderly. According to the laws and regulations related to pension institutions, pension institutions can generally be divided into three different types of pension institutions: public office pension institutions, public and private pension institutions, and private pension institutions according to the different funding entities. At present, pension institutions are facing internal and external legal risks, and should prevent the current legal risks of pension institutions by establishing a correct understanding, scientifically and rationally deploying pension institutions, and establishing a reasonable social resource coordination mechanism for pension institutions.
