论高质量发展理念下的单位刑罚制度的完善

摘　　要：高质量发展是全面建设社会主义现代化国家的首要任务。其本身蕴含了深刻的现代单位犯罪治理理念,如“公私共治”、“保护为主、惩罚为辅”和法治经济理念。囿于我国目前单位刑罚体系具有行刑交叉案件处罚体系上混乱、单位犯罪刑罚制度单一、惩治不足问题,缺乏制裁体系的梯度设计的科学性、规范性问题。应坚持缓和的违法一元论,对于同一行为触犯不同法规范,应当区别刑法与行政法规范在规范保护目的、逻辑体系、制裁手段等方面的差异。依照比例原则,“行刑衔接”案件的制裁体系应当具有逻辑上的协调性,与规范目的的适当性,以及必要性。此外,借鉴域外法人犯罪刑罚制度,顺应高质量发展理念,应当完善我国单位刑罚制度,通过设置缓刑、增加资格刑、设立白名单、黑名单制度和犯罪记录封存制度,促进企业去犯罪化改造、提升企业管理能力,建立具有中国特色的现代化经济行(企)业伦理道德规范体系。To build a modern socialist country in all respects, we must, first and foremost, pursue high- quality development. It itself contains profound modern unit crime governance concepts, such as “public private co governance”, “protection first, punishment second”, and the concept of the rule of law economy. Due to the chaotic punishment system for cross disciplinary cases in China’s current unit punishment system, the single punishment system for unit crimes, and insufficient punishment, there is a lack of scientific and standardized gradient design of the punishment system. We should adhere to the monism of mitigating illegal activities. For the same act that violates different legal norms, we should distinguish the differences between criminal law and administrative law norms in terms of regulatory protection purposes, logical systems, and sanctions. According to the principle of proportionality, the sanctions system for “execution linkage” cases should have logical coordination, appropriateness with regulatory purposes, and necessity. In addition, drawing inspiration from the punishment system for crimes committed by foreign legal entities and in line with the concept of high-quality development, China’s unit punishment system should be improved. By setting up probation, increasing qualification penalties, establishing whitelist, blacklist systems, and criminal record sealing systems, we can promote the decriminalization and transformation of enterprises, enhance their management capabilities, and establish a modern economic (enterprise) ethical and moral code system with Chinese characteristics.
