人工智能创作无障碍阅读版本合理使用的适用制度研究——全国首例“无障碍电影”信息网络传播权纠纷案评析

摘　　要：全国首例“无障碍电影”信息网络传播权纠纷案的争议焦点是俏佳人公司是否做到“无障碍影视”App的最终受益群体仅为视听障碍者。在人工智能创作的背景下,我国无障碍阅读格式版本的合理使用制度存在着“被授权实体”的范围界定不清、人工智能创作无障碍阅读的跨境交换存在传输困境以及人工智能创作获取作品的合法性存疑等困境,有必要在《马拉喀什条约》内容的基础上,完善无障碍阅读合理使用制度条款,在无障碍阅读版本的传输环节引入人工智能技术,必要时可引入无障碍阅读的法定许可来弥补合理使用制度的不足,实现人工智能技术赋能无障碍阅读,促进无障碍阅读产业的高质量发展。The focus of the dispute over the right to disseminate information network of the first “barrier- free movie” in China was whether Pretty Woman had realized that the ultimate beneficiaries of the “Barrier-Free Movie and TV” App were only people with hearing and visual impairments. Under the background of artificial intelligence creation, the fair use system of accessible reading format version in China has the dilemma of unclear definition of the scope of “authorized entity”, the transmission problem of cross-border exchange of accessible reading created by artificial intelligence, and the doubtful legitimacy of the access to the works created by artificial intelligence, etc., and it is necessary to improve the fair use system of accessible reading format version based on the content of the Marrakesh Treaty. On the basis of the content of the Marrakesh Treaty, it is necessary to improve the provisions of the reasonable use system for accessible reading, introduce AI technology in the transmission of accessible reading versions, and if necessary, introduce statutory licenses for accessible reading to make up for the shortcomings of the reasonable use system, so as to realize the empowerment of accessible reading by AI technology, and to promote the high-quality development of the accessible reading industry.
