摘 要:网络直播随着科技的发展越来越多地占据了人们的业余娱乐生活,在这个过程中用户以充值打赏的方式表达对于直播表演的认可,直播平台与主播也因此获得收益。该商业模式在提供娱乐的同时也不可避免地产生许多经济纠纷。当用户的打赏行为存在可撤销、无效事由时,平台是否应当承担责任,目前实践中的判决各异,缺乏统一的标准。学界目前由于对于打赏行为性质的争议过于激烈,进而对于责任的分担问题也未有定论,然而责任分担问题对于纠纷中的当事人有着最直观的影响,亟须解决。因此文章尝试从用户的外部视角出发,绕过对于打赏行为性质的争议,引入外观主义理论,为解决直播打赏纠纷中的责任分配问题提供新的思路。With the development of science and technology, online live broadcast has increasingly occupied people’s amateur entertainment life. In this process, users express their recognition of live performances by topping up and rewarding, and the live broadcast platform and anchors also make profits. While providing entertainment, this business model inevitably generates many economic disputes. When there are revocable reasons for a user’s tipping behavior, whether the platform should bear the corresponding liability. The judgments in current practice are different, and there is a lack of unified standards. At present, due to the fierce controversy over the nature of tipping behavior, the issue of responsibility allocation has not been determined, but the issue of responsibility allocation has the most intuitive impact on the parties in the dispute and needs to be solved urgently. Therefore, this paper attempts to bypass the controversy over the nature of tipping from the external perspective of users and provides a new idea for solving the problem of responsibility allocation in live streaming tipping disputes.
