摘 要:我国现有的法律框架却不足以使女性平等就业权得到很好的保护,在实践中存在着性别就业歧视司法认定不清、与民事侵权构成要件混同、诉讼竞合等问题。这些问题阻碍了对遭遇性别就业歧视受害者的权利救济。通过对司法实践中出现的问题进行分析,并借鉴域外相关立法和监察机制的先进经验,为我国相关体制的完善提出建议:制定专门的《反就业性别歧视法》并完善社会保障制度,同时建立反就业性别歧视的监察机制,进而构建起一个保护女性平等就业权的完整体系。The existing legal framework in our country is insufficient to provide adequate protection, and there are issues such as unclear judicial identification of gender employment discrimination, confusion with the elements of civil tort, and litigation competition in practice. These issues hinder the rights relief for victims of gender employment discrimination. By analyzing the problems that arise in judicial practice and drawing on advanced experiences from related legislation and supervisory mechanisms abroad, suggestions are proposed for the improvement of our country’s relevant systems: to formulate a special “Anti-Employment Gender Discrimination Law” and improve the social security system, while establishing a supervisory mechanism against employment gender discrimination, thereby constructing a complete system to protect women’s equal employment rights.
