摘 要:自2015年启动至今,“一带一路”建设成绩斐然,举世瞩目。然则因沿线国家的跨度之大、参与数量的不断增加和各个国家的所属法系、文化背景、市场开放程度、贸易政策、国民素质等均不相同,故而在“一带一路”的建设过程中,也会出现诸多法律上的碰撞,除了最典型的法律冲突问题,还存在诸如知识产权保护、生态环境保护、劳工保护、贸易保护等方面的问题。其中的劳工法律问题关乎劳工权益保护和企业社会责任的承担,意义重大。政府和企业都亟待对这一重要问题做出积极回应,以保障我国劳工在“一带一路”建设过程中的各项合法权益不受侵犯。Since its launch in 2015, the “Beltand Road” construction has made remarkable achievements and attracted worldwideattention. But because of the large span of countries along the line, the increasing number of participants and countries oflegal system, cultural background, market openness, trade policy, nationalquality are different, so in the process of “Belt and Road” construction,there will be many legal collision, in addition to the most typical legalconflict, there are such as intellectualproperty protection, ecological environment protection, labor protection, tradeprotection. Among them, the labor legal issues are related to theprotection of labor rights and interests and corporate social responsibility,which is of great significance. Both the government and enterprises urgentlyneed to respond positively to this important issue to protect the legitimaterights and interests of Chinese workers in the process of the construction of “Beltand Road”.
