摘　　要：当前,在世界范围内尚未形成有关国际游客和到访者权益保护的国际机制,如何保护国际游客的权益仍然处于困境之中。2015年1月,自巴西政府向海牙国际私法会议提交《国际旅游者司法救助与合作公约(草案)》起,如何更切实地保护国际游客当事人的合法权益变得尤为重要。海牙国际私法会议也曾试图拟定一个《国际旅游者司法救助与合作公约(草案)》来保护国际游客的权利,但是经过海牙国际私法会议项目专家小组多年研究,综合借鉴各方提出建议,认为现有机制可能已经足够能帮助国际游客、到访者维护他们的权益。专家小组认为可以通过制定一份《指南》向国际游客提供有关解决跨境纠纷以及就他们所可能遇到的法律问题诉诸司法的信息。就在线纠纷解决经验方面,中国大陆和中国香港已经有了较为丰富的经验。因此中国加强对该《指南》的研究,立足中国实践,加强与周边各国的合作,提高对国际游客和到访者的保护力度,更好地维护他们的合法权益。At present, there is no internationalmechanism to protect the rights and interests of international tourists andvisitors in the world, and there is still a dilemma in how to better protectthe rights and interests of international tourists. In January, 2015, theBrazilian government submitted the Convention on Judicial Assistance andCooperation for International Tourists (Draft) to The Hague Conference onPrivate International Law. How to protect the legitimate rights and interestsof international tourists more effectively has become more important. Afteryears of research by the expert group of the ODR (“Online Dispute Resolution”)project of The Hague Conference on Private International Law, and comprehensivereference to the suggestions put forward by all parties, it is considered thatthe existing mechanism may be enough to help international tourists andvisitors to safeguard their rights and interests, and a guide should beformulated to provide international tourists with information on solvingcross-border disputes and seeking justice for legal problems they mayencounter. Chinese mainland and Hongkong, China already have rich experience inonline dispute resolution. Therefore, China should strengthen the study of theGuide, base itself on Chinese practice, strengthen cooperation with neighboringcountries, improve the protection of international tourists and visitors, and bettersafeguard their legitimate rights and interests.
