摘　　要：业务过失犯罪是我国刑法的重要类型,在我国刑法中占据大量篇幅,然而业务过失犯罪一直是我国法学研究的薄弱地带,理论上存在诸多疑难问题尚未得到解决,尤其是业务过失的注意义务模糊不清,因此应当在厘清过失犯的构造后明确很大一部分业务过失的注意义务标准应当根据空白罪状进行认定,同时利用过失犯规范保护目的理论明确能够认定业务过失注意义务的空白罪状范围。同时通过信赖原则和被允许的危险理论等注意义务阻却事由限制业务过失的成立范围。理解业务过失注意义务标准和空白罪状之间的关联。Professional negligence crime is an important type of Criminal law in China, which occupies a large number of pages in the criminal law of China. However, professional negligence crime has always been a weak area of legal research in China. Theoretically, there are many difficult problems that have not been solved;especially the duty of care of profes-sional negligence is unclear. Therefore, after clarifying the structure of negligent offenders, it should be clear that a large part of the duty of care standards of business negligence should be identified according to blank charges, and the scope of blank charges that can identify duty of care of business negligence should be clarified by using the theory of normative protection purpose of negligent of-fenders. At the same time, the establishment scope of business negligence is limited by the princi-ple of trust and the allowable risk theory. The relationship between the standard of duty of care for business negligence and blank charges is understood.
