摘　　要：伴随网络技术的发展,网络空间的法治化进程也正在逐步加快,国际法在网络空间治理中的作用也日益受到重视。当前运用国际法治理网络空间面临着各国利益博弈、网络空间相关法规不健全、联合国难以有效发挥作用等问题。运用国际法治理网络空间必须在遵循据《联合国宪章》提出的“互联网治理四项原则”以及“和平共处五项原则”的基础上,促使各国应积极开展合作,重视非国家行为体在推进法治中的作用,重点把握网络空间治理中的突出问题,并同步促进各国法律的发展。Along with the development of network technology, the process of rule of law in cyberspace is gradually accelerating, and the role of international law in the governance of cyberspace is also receiving increasing attention. Currently, the use of international law in the governance of cyberspace faces problems such as the game of national interests, the lack of sound regulations in cyberspace, and the difficulty of the United Nations to play an effective role. The use of international law to gov-ern cyberspace must be based on the “four principles of Internet governance” and the “five princi-ples of peaceful coexistence” put forward in the UN Charter, and urge countries to actively carry out “Cyber diplomacy”, pay attention to the role of non-state actors in promoting the rule of law, focus on the outstanding issues of cyberspace governance, and promote the development of national laws at the same time.
