摘　　要：《最高人民法院、最高人民检察院关于办理破坏野生动物资源刑事案件适用法律若干问题的解释》采取了以“经济价值”为主的入罪标准,同时规定了与“生态价值”相关的出罪条款。在环境犯罪中,由于价值目标是保护生态环境,该入罪标准是否具有合理性,尚需厘清“生态价值”与“经济价值”所指向的价值诉求。考虑到“生态价值”的本质是主体间的社会关系,而非人与自然的主客关系,无论是“人类中心论”还是“自然中心论”,都面临来自生态价值理念的根本质疑。同时,由于评估主体的差异化、评估对象的模糊性以及评估标准的多元化,“生态价值”在评估机制上存在复杂性。将“经济价值”纳入刑法评价的范围,能够克服生态价值评估机制的不足,但尚不足以评价行为的刑事违法性,仍需考察“生态价值”这一环境犯罪的基本价值取向。The Inter-pretation of the Supreme People’s Court and the Supreme People’s Procuratorate on Several Issues Concerning the Application of Laws in Handling Criminal Cases of Destruction of Wildlife Resources has adopted the standard of incrimination based on “economic value”, and has also stipulated the crime clause related to “ecological value”. In environmental crime, as the value goal is to protect the ecological environment, whether the standard of criminalization is reasonable still needs to clarify the value demands of “ecological value” and “economic value”. Considering that the essence of “eco-logical value” is the social relationship between subjects, rather than the subject object relationship between man and nature, both “anthropocentrism” and “natural centrism” face fundamental doubts from the concept of ecological value. At the same time, due to the diversity of the assessment sub-ject, the fuzziness of the assessment object and the diversification of the assessment criteria, the “ecological value” has complexity in the assessment mechanism. Bringing “economic value” into the scope of criminal law evaluation can overcome the shortcomings of the ecological value evaluation mechanism, but it is not enough to evaluate the criminal illegality of acts. It is still necessary to investigate the basic value orientation of “ecological value” as an environmental crime.
