摘  要:随着信息技术的发展,内容产业随之兴起,短视频、网络直播、网上课堂都成为了我们生活中常用的娱乐、学习工具。然而,内容产业并未得到充分的保护,侵权现象仍屡见不鲜。由于大多数内容产业的载体是口述作品,因此本文就口述作品构成要件、体系地位、保护模式存在的较大争议进行讨论,从而汇总观点、明确焦点,以促进口述作品的认定和保护。具体而言,本文认为在构成要件方面,“未经任何物质媒介固定”并非口述作品的构成要件;在体系地位方面,应当保留现行的作品类型划分;在保护模式方面,应参照文字作品的保护标准,将其与文字作品共通保护。With the development of information technology, the content industry has emerged. Short videos, webcasts, and online classes have all become entertainment and learning tools commonly used in our lives. However, the content industry is not fully protected, and infringements are still common. Since the carrier of most content industries is oral works, this article discusses the major controver-sies of oral works’ constituent elements, system status, and protection mode, so as to summarize scholars’ opinions and clarify the controversial focus, so as to promote the recognition and protec-tion of oral works. Specifically, this paper believes that in terms of constituent elements, “not fixed by any material” is not a constituent element of oral works;in terms of system status, the current division of works should be retained;in terms of protection mode, reference should be made to the protection standards of written works.
