摘　　要：政府公共服务外包,即政府与社会组织通过签订合同和委托的方式达成服务协议,将部分基础的公共服务由政府转移到社会组织。政府公共服务外包在一定程度上,缓解了政府的财政负担,并提升了公共服务的专业化水平。但是,我国政府在公共服务外包实践中依然存在诸多困扰。在立法方面,未形成针对性、系统性的法律规范体系;在执法协助方面,存在公共服务外包边界不清晰和执法协助范围模糊等问题;在公共服务外包监管方面,因合同决策、合同缔结及合同履行产生的大量风险问题。因此,完善法律规范,明确公共服务外包的目的;明晰执法协助范围,加强工作人员的培训工作;健全监管机制,提高公共服务质量等措施显得尤为重要。Government public service outsourcing refers to the transfer of part of basic public services from the government to social or-ganizations through a service agreement reached between the government and social organizations through signing contracts and entrustment. To some extent, the outsourcing of government public services relieves the financial burden of the government and promotes the specialization level of public services. However, our government still has many problems in the practice of public service outsourcing. In terms of legislation, no targeted and systematic system of legal norms has been formed. In the aspect of law enforcement assistance, there are problems such as unclear boundary of public service outsourcing and vague scope of law enforcement assistance. In the supervision of public service outsourcing, there are a lot of risks arising from contract decision, contract conclusion and contract performance. Therefore, to improve the legal norms, clear the purpose of public ser-vice outsourcing;clarify the scope of law enforcement assistance and strengthen staff training;it is particularly important to improve the supervision mechanism and ensure the quality of public ser-vices.
