摘 要:教育领域的行政规范性文件不仅弥补了法律的缺陷,其对教育领域的发展也有一定的规范和促进作用。但由于教育立法层面的不完整、规范性文件名称不规范、权限不明确、监督机制不健全和民众参与不足等问题,导致教育行政规范性文件存在着一定漏洞,制约了教育领域改革的步伐。本文通过分析教育领域规范性文件(以上海市为例)制定过程和监督机制中所存在的问题,提出了规范名称、明确权限、增加民众参与以及完善监督机制的突破思路,旨在促进各级教育行政部门能够科学运用规范性文件来行使行政职能,保障教育领域的发展,切实维护相对人的合法权益。Administrative normative documents in the field of education not only make up for legal deficiencies, but also have a certain normative and promoting effect on the development of the education field. However, due to incomplete education legislation, nonstandard names of normative documents, unclear powers, inadequate supervision mechanisms, and insufficient public participation, there are certain loopholes in the normative documents of education administration, which restrict the pace of education reform. This article analyzes the problems in the process of formulating normative documents in the field of education (taking Shanghai as an example) and the supervision mechanism, and proposes breakthrough ideas for standardizing names, clarifying powers, increasing public participation, and improving supervision mechanisms. The aim is to promote the scientific use of normative documents by education administrative departments at all levels to exercise administrative functions, ensure the development of the education field, and effectively safeguard the legitimate rights and interests of individuals.
