摘  要:由于“外挂”性质认定上存在的专业壁垒,网络游戏外挂认定问题在刑事司法中存在着罪名适用不一、裁判理由欠缺、帮助责任认定不足的问题。刑法规制的外挂应当仅包括数据包修改式外挂。数据包修改式外挂仅对游戏程序客户端施加影响,不宜将其认定为对计算机信息系统的“破坏”、“侵入”与“控制”。《刑法修正案(十一)》修改后,法官在实务案件处理过程中应当排除内存修改式外挂与操作模拟式外挂相关行为的刑法适用,以侵犯著作产权罪为基本定罪规则,统一外挂案件适用罪名,维护刑法谦抑性,坚持罪刑法定原则。Due to the professional barriers in the determination of the nature of “plug-ins”, the problem of identifying online game plug-ins has problems in criminal justice such as inconsistent application of crimes, lack of reasons for adjudication, and insufficient determination of responsibility for help. Plug-ins for criminal regulations shall include only package-modified plug-ins. The packet-modified plug-in only affects the game program client, and it should not be identified as “sabotage”, “intrusion” and “control” of the computer information system. After the revision of the Criminal Law Amendment (11), judges shall, in the process of handling practical cases, exclude the application of the criminal law of acts related to memory modified plug-ins and operational simulation plug-ins, take the crime of infringing copyright as the basic conviction rule, unify the application of crimes in plug-in cases, safeguard the modesty of the criminal law, and adhere to the principle of criminality and legality.
