摘　　要：对于涉众型经济犯罪的典型——非法吸收公众存款罪,因其涉案金额巨大、集资人数众多、财产处置困难等特点及人民法院处理该类案件重审判而轻执行的现状,导致集资参与人的损失无法得到有效弥补,易引发群体事件,损害司法权威及公信力,影响社会的稳定发展。如何挽回集资参与人的损失,保障其权益成了司法实践中的重中之重。考虑到被执行人的财产不足以同时满足承担财产刑和承担民事赔偿责任的现状及民事优先的原则,本文以S市J区人民法院执行局受理的非法吸收公众存款罪的执行案件为样本,以涉案财产的处置和违法所得追缴、责令退赔为切入点,分析当前实践中的困境,提出减少、挽回集资参与人损失的可行性建议,以期对破解该类案件的执行难题有所裨益。For the typical case of stakeholder economic crimes—the crime of illegally absorbing public deposits, due to its large amount of money involved, large number of fundraisers, difficulties in property disposal, and the current situation of people’s courts handling such cases with heavy trial and light execution, the losses of fundraising participants cannot be effectively compensated, which can easily lead to group events, damage judicial authority and credibility, and affect the stable development of society. Therefore, how to recover the losses of fundraising participants and protect their rights has become a top priority in judicial practice. Considering that the property of the person subjected to execution is insufficient to meet the current situation of bearing both property penalties and civil compensation responsibilities, as well as the principle of civil priority, this article takes the execution cases of non suction crimes accepted by the Executive Bureau of J District People’s Court in S City as a sample, and takes the disposal of the involved property, the recovery of illegal gains, and the order to refund compensation as the entry point. It analyzes the current difficulties in practice and proposes feasible suggestions to reduce and recover the losses of fundraising participants. It is expected to be beneficial for solving the execution difficulties of such cases.
