多元司法功能实现的困境与出路

摘　　要：司法功能作为司法所欲实现的功能,对司法权的运转起着指导作用,法官在个案裁判中必须考虑其裁判结果是否能够满足司法功能实现的要求。目前学界普遍认为司法功能可分为法理功能和社会功能,且随着依法治国进程的推进,政治功能也被列入了司法功能之一。对司法功能认识的不断改变意味着对司法认识的深入,也代表了当今社会、现阶段国家发展对司法的依赖。这种依赖使得社会因素与政治因素不断侵蚀司法的本体功能,出现重司法的社会功能、政治功能而轻司法的法理功能的问题。因此个案中究竟如何恰当反映司法功能,是一项亟待解决的问题。美国最高法院的司法最低限度主义提倡司法判决应当“窄”而“浅”,将判决的范围限制在个案之中,从而将司法的法理功能很好的与政治功能相结合,可以为我国对司法建设提供借鉴意义。为实现司法三大功能的融合,应当以法理功能为基点,强调个案判决思维,就个案展开说理论证。Judicial function, as a function to be realized by the judiciary, plays a guiding role in the operation of the judicial power, and judges must consider whether the results of their decisions can satisfy the requirements for the realization of the judicial function in individual cases. At present, it is generally recognized that judicial function can comprise jurisdictional function and social function, and political function with the advancement of the process of the Rule of Law. The changing understanding of the judicial function means deepened understanding of justice, but also represents the judicial dependence of today’s society. This dependence has led to the erosion of the ontological function of justice by social and political factors, and the problem of emphasizing the social and political functions of justice over the jurisdictional function of justice has arisen. Therefore, the question of how to appropriately reflect the judicial function in individual cases is urgent. The U.S. Supreme Court’s judicial minimalism advocates that judicial decisions should be “narrow” and “shallow”, limiting the scope of the judgment to individual cases, thus combining the jurisdictional function with the political function, which can be a reference for our country’s judicial construction. In order to realize the integration of the three functions of justice, we should take the jurisdictional function as the base, emphasize the thinking of case-by-case judgments, and carry out theoretical proofs on individual cases.
