摘　　要：法律可以在抽象层面被视作是规范性秩序的制度化。正式规范和权威的出现则代表了非正式规范性秩序到正式规范性秩序的制度化转变,特别是制定处于核心地位的宪法的过程。共同体对规范的共同信念具有根本地位。将这一共同信念植于法律体系,能够提供一种对于法律规范性来源的解答,即来源于一种默示的规范共识,蕴含彼此期待的信任,以宪法为核心的现代法律体系奠基于此。Law can be seen at the abstract level as the institutionalization of the normative order. The emergence of formal norms and authority represents an institutionalized transition from an informal normative order to a formal normative order, especially the process of formulating a constitution at its core. The Community’s shared belief in norms is fundamental. Embedding this shared belief in the legal system provides an answer to the normative sources of law, that is, from an implicit normative consensus, implying mutual expectation of trust, on which the modern legal system with the Constitution at its core is based.
