摘　　要：《中华人民共和国人民陪审员法》(简称《人民陪审员法》)的颁布实施标志着人民陪审员制度踏入了一个崭新时代,现该法实施已经五年有余,在过去的五年里,人民陪审员制度在司法实践中的表现有可圈可点之处,但是在人民陪审员的选任机制、只参与事实审机制、参与调解机制以及人民陪审员参与庭前阅卷机制等方面依然存在问题。从世界范围来看,陪审制度的发展多集中在刑事诉讼领域,民事陪审制度大致呈现一种“衰而不败”的发展态势,我国也不例外。本文以民事陪审制度为研究对象,对上述问题进行分析,参考域外陪审制度的经验,结合我国国情和民事诉讼的特点,笔者认为应当降低人民陪审员的学历要求、明确专业陪审员的参审机制、扩大事实审的范围以及完善人民陪审员参与调解机制与庭前阅卷机制。The promulgation and implementation of the People’s Juror Law of the People’s Republic of China (referred to as the People’s Juror Law) marks that the people’s juror system has entered a new era. The law has been implemented for more than five years. In the past five years, the performance of the people’s juror system in judicial practice has been commendable. However, there are still some problems in the selection and appointment mechanism of people’s assessors, the mechanism of only participating in factual trial, the mechanism of participating in mediation and the mechanism of people’s assessors participating in pretrial examination. From the perspective of the world, the development of jury system is mainly concentrated in the field of criminal procedure, and the civil jury system generally presents a development trend of “failing and undefeated”, and China is no exception. This paper takes the civil jury system as the research object, analyzes the above problems, refers to the experience of the foreign jury system, combined with the national conditions of China and the characteristics of civil litigation, and thinks that the educational requirements of people’s jurors should be reduced, the participation mechanism of professional jurors should be clarified, the scope of factual trial should be expanded, and the mechanism of people’s jurors’ participation in mediation and precourt examination should be improved.
