摘  要:近些年,个人信息保护问题越来越受到学界以及普通消费者的重视。我国《民法典》中对于网络信息安全进行了专章规定,2021年出台的《中华人民共和国个人信息保护法》也对个人信息保护进行了更加详细的规定,但对于网络消费者的个人信息保护仍然存在一定的不足。本文旨在通过分析我国对网络消费者个人信息保护存在的问题以及对比美国在此方面的法律规定,最终提出解决问题的策略。我们应当加强电商行业内部的自我管理,同时还应继续对相关法律法规进行完善,这样才能使得信息自由流通和保护网络消费者个人信息相协调。In recent years, the issue of personal information protection has been paid more and more attention by academics and ordinary consumers. China’s Civil Code has a special chapter on network information security, and the Personal Information Protection Law of the People's Republic of China issued in 2021 also has more detailed provisions on personal information protection, but there are still certain deficiencies in the protection of personal information of online consumers. This paper aims to analyze the problems existing in the protection of personal information of Internet consumers in China and compare the legal provisions of the United States in this respect, and finally put forward the countermeasures to solve the problems. We should strengthen self-management within the e-commerce industry and continue to improve relevant laws and regulations so that the free flow of information and the protection of online consumers’ personal information can be coordinated.
