摘　　要：物权法定原则的规范内容即是指“定什么”和“法什么”的问题。从法条文义来看,物权法定原则的适用范围只能是物权的种类和内容,且物权的种类和内容形成了一一对应的组合。通过对于物权法定原则立法目的及适用范围的分析,软化物权法定原则有必然性和可行性。我国对物权法定原则所依据的“法”做了最狭义的解释,但物权法对物权内容的框架性规定,使得物权法定原则下仍有一定的自治空间。为了使物权法定原则不流于虚名,习惯物权必须审慎适用,并受到物权法定原则的严格审查。The normative content of the numerus clauses principle refers to the questions of “what to determine” and “what to law”. From the viewpoint of legal definition, the scope of application of the numerus clauses principle can only be the type and content of property right, and the type and content of property right form a one-to-one corresponding combination. By analysing the legislative purpose and the scope of application of the numerus clauses principle, the softening of the numerus clauses principle is inevitable and feasible. China’s the numerus clauses principle is based on the “law” to do the narrowest interpretation, but the property law on the content of the property rights of the framework provisions, so that the numerus clauses principle still has a certain degree of autonomy space. In order to ensure that the numerus clauses principle does not exist in name only, customary property rights must be applied carefully and be subject to the strict scrutiny of the numerus clauses principle.
