摘 要:我国《海商法》自1993年7月1日颁布以来,解决了我国众多海事纠纷,加快了我国与世界其他国家的经济交流,加快了我国前进的步伐。但由于该法颁布时间久、修改频率低,以至于难以完全满足司法实践的需要。本文基于《海商法》的相关规定和实践中船舶留置权的相关判例,综合实践现状,对于司法裁量下和学理上的船舶留置权的占有问题进行研究,总结占有的认定情形并给出完善建议。Since China’s maritime law was promulgated on July 1, 1993, it has solved many maritime disputes, accelerated the economic exchange between our country and other countries in the world, and accelerated the pace of our country. However, due to the long promulgation time and low frequency of amendment, it is difficult to fully meet the needs of judicial practice. Based on the relevant provisions of the Maritime Law and the relevant precedents of ship liens in practice, this paper studies the possession of ship liens under judicial discretion and in theory, summarizes the identification of possession and gives suggestions for improvement.
