摘 要:夫妻之间的房产给予不仅决定婚姻的缔结与否,也影响着夫妻关系的和谐稳定。夫妻间房产给予约定本质上既不属于狭义的夫妻财产制约定,也不等同于赠与合同,而应将其界定为夫妻间的特殊赠与。对此,夫妻房产给予约定在对内效力上应借鉴德国法理论,严格限制撤销权的适用,使给予方在给付前不享有任意撤销权;在给付后,若受赠方存在重大婚姻过错场合,赠与一方可行使法定撤销权,同时为保护给予一方,判决中可扩张适用情势变更规则以寻求救济。就外部效力而言,夫妻间房产给予约定在未经法定公示之前,仅具有债的约束力。The provision of property between spouses not only determines the conclusion of marriage, but also affects the harmony and stability of the relationship. In essence, the agreement on the granting of real estate between husband and wife is neither a narrow agreement on the marital property system, nor is it equivalent to a gift contract, but should be defined as a special gift between husband and wife. In this regard, the agreement on spousal property should draw inspiration from German legal theory in terms of internal effectiveness, strictly limit the application of revocation rights, so that the giving party does not have any revocation rights before payment;after payment, if the recipient has a major marital fault, the donating party may exercise the statutory right of revocation. At the same time, in order to protect the giving party, the application of the change of circumstances rule can be expanded in the judgment to seek relief. In terms of external effectiveness, the property agreement between spouses only has the binding force of a debt until it is legally disclosed.
