摘 要:“双轨制”指的是我国内河水路货物运输和海上货物运输分属于两个不同的法律体系管制,且《海商法》第四章“海上货物运输合同”将沿海水路货物运输排除在其适用范围之外的一种制度模式。这种模式对水路货物运输活动具有巨大的影响,其形成是在特殊的时代背景下做出的特殊选择。但在如今的市场背景下,“双轨制”已无法适应经济发展的需要。本文将通过阐述“双轨制”的主要内容,并分析废除“双轨制”的必要性及可行性,最终得出需在《海商法》修改中,对内河水路货物运输和海上货物运输的法律体系进行统一的结论。The “dual-track system” refers to the system mode that the inland waterway cargo transport and the maritime cargo transport belong to two different legal systems, and the “Contract of Carriage of goods by Sea” in Chapter 4 of the Maritime Law excludes the coastal waterway cargo transport from its scope of application. This mode has a great impact on the water cargo transportation activities, and its formation is a special choice made in a special era. However, in today’s market context, the “dual-track system” has been unable to meet the needs of economic development. This paper will explain the main content of the “double track system” and analyze the necessity and feasibility of abolishing the “double track system”, and finally draw the conclusion that it is necessary to unify the legal system of inland waterway cargo transport and maritime cargo transport in the revision of the “Maritime Law”.
