摘　　要：本文通过论述60周岁以上老年人在遭受人身损害后寻求法律救济遇到的法律困境,剖析共同富裕背景下亟需以实际情况给予其误工费及被扶养人生活费的原因,从而得出放宽裁量标准存在必要性的结论。This paper discusses the legal difficulties encountered by the elderly over 60 years of age in seeking legal relief after suffering personal injury, analyzes the reasons why it is urgent to give them the charge for loss of working time and the living expenses of their dependents according to the actual situation in the context of common prosperity, and concludes that it is necessary to relax the discretion standards.
