摘 要:作为行政平等对待、抑制恣意的规则机制,行政裁量基准在为行政裁量活动划定统一标准的基础上,能够产生对外法律效力。裁量基准存在的必要性、行政的自我拘束和裁量基准作为软法规范的效力,共同形成裁量基准具有法律效力的法理基础。行政裁量基准法律效力的具备,需符合制定主体适格、规则公开、符合基本法律原则等合法性要件。鉴于裁量规则包容范围的有限性,拘束裁量和允许逸脱构成了行政裁量基准法律效力的双向特征。As a rule mechanism for administrative equal treatment and the suppression of arbitrariness, administrative discretionary benchmarks are able to produce external legal effects on the basis of setting uniform standards for administrative discretionary activities. The necessity of the existence of discretionary benchmarks, administrative self-restraint and discretionary benchmarks as a soft law norms of the effectiveness of discretionary benchmarks together to form the legal basis of legal effect of discretionary benchmarks. The legal effect of administrative discretionary benchmarks, need to comply with the formulation of the main body eligible, open rules, in line with the basic principles of law and other legality requirements. In view of the limited scope of the discretionary rules, constraints on discretion and allow escape constitute the two-way characteristics of the legal effect of administrative discretionary benchmarks.
