摘　　要：元宇宙是基于Web 3.0技术体系和运行机制形成的数字生态系统。随着VR (虚拟现实)、AR (增强现实)、区块链技术的发展,元宇宙开始从概念转为现实。然而,元宇宙发展初期面临着许多困境,如虚拟主体多样化会引发各种犯罪问题、数字交易的安全难以得到保障、用户的隐私与个人信息泄露等问题,亟待法律作出回应。为了保障元宇宙秩序的平稳运行,必须加强预防与引导,在现存法律框架的基础上建立一套治理体系,实现虚拟社会与现实社会的健康发展。The metaverse is a digital ecosystem formed based on the Web 3.0 technology system and operating mechanism. With the development of VR (Virtual Reality), AR (Augmented Reality), and blockchain technology, the metaverse has begun to shift from concept to reality. However, in the early stages of the development of the metaverse, there were many challenges, such as the diversification of virtual entities leading to various criminal problems, the difficulty in ensuring the security of digital transactions, and the leakage of user privacy and personal information, which urgently needed legal responses. In order to ensure the smooth operation of the metaverse order, it is necessary to strengthen prevention and guidance, establish a governance system based on the existing legal framework, and achieve the healthy development of virtual society and real society.
