摘　　要：民间文艺承载着丰富的文化内涵和民族精神,但其著作权保护存在不足,影响了创作者的积极性和民间文艺的传承发展。明确权利主体是保护民间文艺作品著作权的关键,构建集体管理制度可以确保民间文艺作品的合法权益得到有效保护。本文深入探讨了我国民间文艺作品著作权集体管理制度的构建问题,分析了现状、问题和可行性,提出了构建策略,明确了集体管理组织的职能与定位,建立了完善的著作权备案登记制度,制定了合理的著作权使用费分配机制,并强调了保护与发展的重要性。Folk literature and art carry rich cultural connotation and national spirit, but their copyright protection is insufficient, which affects the enthusiasm of creators and the inheritance and development of folk literature and art. Defining the subject of rights is the key to protect the copyright of folk works, and building a collective management system can ensure the effective protection of the legitimate rights and interests of folk works. This paper deeply discusses the construction of the collective management system of copyright of folk literary and artistic works in China, analyzes the current situation, problems and feasibility, puts forward the construction strategy, clarifies the functions and positioning of the collective management organization, establishes a perfect copyright filing and registration system, makes a reasonable copyright royalty distribution mechanism, and emphasizes the importance of protection and development.
