摘　　要：算法推荐技术的兴起,既是网络服务提供者的机遇,也是他们所要面临的挑战。这种技术通过分析用户的行为习惯、偏好和互动数据,能够精准地向用户推送个性化内容,极大地提升了用户体验和满意度。然而,这种个性化推送的另一面,是网络服务提供者在不经意间可能触碰到著作权侵权的红线。因为算法推荐系统可能会将未经授权的作品推荐给用户,从而引发侵权纠纷。本文旨在通过从理论和实践两个角度对当前现状进行分析,从而优化网络服务提供者的注意义务制度,以此来促进算法推荐技术的规范和健康发展,实现网络服务提供者和著作权者之间法律利益的再平衡。The rise of algorithm recommendation technology presents both opportunities and challenges for online service providers. By analyzing users’ behavior patterns, preferences, and interaction data, this technology can accurately push personalized content to users, greatly enhancing user experience and satisfaction. However, on the flip side of this personalized recommendation, online service providers may inadvertently cross the line of copyright infringement. This is because algorithm recommendation systems may recommend unauthorized works to users, thereby triggering infringement disputes. This paper aims to analyze the current situation from both theoretical and practical perspectives, in order to optimize the duty of care system for online service providers. By doing so, it seeks to promote the standardized and healthy development of algorithm recommendation technology and achieve a rebalancing of legal interests between online service providers and copyright holders.
