摘  要:电商平台实行“仅退款不退货”规则以来,虽维护了消费者权益和督促商家提高产品质量,但在实行过程中也产生一些问题:消费者滥用民事权利,违反诚信、公平交易原则,借平台规则绕过商家申请仅退款,造成商家钱货两空,严重损害了商家合法权益。“仅退款不退货”问题涉及到平台、商家和消费者的权利义务,以及三方在交易中的处理方式。因此平台要平衡买卖双方利益,商家和消费者都应遵守法律法规和平台规则,诚信交易,才能优化法治化营商环境,刺激消费,实现经济高质量发展。Since the implementation of the e-commerce platform “only refund and no return” rule, although the protection of consumer rights and urges businesses to improve product quality, in the implementation process also produced some problems: consumers abuse civil rights, in violation of the principle of integrity, fair trading, by platform rules to bypass businesses to apply for only refund, causing merchants to empty money and goods, seriously damaging the legitimate rights and interests of businesses. The issue of “only refund but not return” involves the rights and obligations of the platform, merchants and consumers, as well as the treatment of the three parties in the transaction. Therefore, the platform should balance the interests of both buyers and sellers, merchants and consumers should abide by laws and regulations and the rules of the platform, and conduct honest transactions, so as to optimize the business environment under the rule of law, stimulate consumption, and achieve high-quality economic development.
