电商式网络传销的法律规制研究

摘　　要：电子商务的发展和电商模式的不断创新,推动了社会经济的发展,但也有不法分子以电商模式创新为借口,通过电子商务平台实施网络传销犯罪。本文以BMC电商模式(企业、中间监管者、消费者的简称)为引,明确电商模式创新和电商式网络传销行为各自的特点,从而界定电商模式创新与电商式网络传销行为的界限,并分析目前电商式网络传销犯罪的法律规制中存在的问题,也即隐蔽性强难以识别,执法体制规定不合理,侦查取证方面存在的困境等,对此针对性地提出提升公众识别能力与完善监管体系、规范行政执法、优化侦查取证等一系列完善建议,以期遏制电商式网络传销行为,在不打击市场主体创新电商模式积极性的基础上打击网络传销行为,保障社会经济稳定和人民财产安全。The development of e-commerce and the continuous innovation of e-commerce mode have promoted the development of social economy, but there are also criminals who take the innovation of e-commerce mode as an excuse to carry out the crime of online pyramid selling through the e-commerce platform, and have stronger harm than the traditional pyramid selling crime. This paper focuses on BMC e-commerce model (short for enterprises, intermediate regulators and consumers), and clarifies the characteristics of e-commerce model innovation and e-commerce online pyramid selling behavior, to define the boundary between e-commerce model innovation and e-commerce network pyramid selling behavior, and analyze the problems existing in the legal regulation of e-commerce network pyramid selling crime, that is, it is highly hidden and difficult to identify;the law enforcement system is unreasonable and dilemma existing in the investigation and evidence collection.
