摘 要:如今,线上团购经济已然成为了电商经济模式的重要组成部分,但是,完全依仗市场秩序的自我调节对于规制线上团购经济而言是不足够的,实践中部分团购平台利用其在市场中的支配地位以设置霸王条款的方式侵害消费者的合法权益,破坏公平竞争的市场交易秩序与安定和谐的社会生活环境。因此,本文通过分析线上团购平台霸王条款的产生原因及表现形式,结合现行法律法规的规定与不足,探讨在电商经济背景下线上团购平台规制霸王条款的法律路径与完善建议,以达到维护交易安全,保障当事人合法权益的目的。Nowadays, online group buying economy has become an integral part of the e-commerce economic model. However, relying solely on the self-regulation of market order is insufficient to effectively govern the online group buying economy. In practice, some group buying platforms exploit their dominant market position to impose unfair terms, infringing upon consumers’ legitimate rights and interests, disrupting the fair competition of market transactions, and undermining a stable and harmonious social environment. Therefore, this paper analyzes the manifestations and causes of unfair terms on online group buying platforms, examines the provisions and shortcomings of existing laws and regulations, and explores legal pathways and improvement suggestions for regulating unfair terms in the context of the e-commerce economy. The ultimate goal is to safeguard transaction security and protect the legitimate rights and interests of all parties involved.
