摘 要:从既有的司法判例看,商标许可使用纠纷已不再限于许可双方的合同争端,还扩及到商标竞争秩序和消费者信赖利益保护方面,前者由合同法规制,后者则是商标法调整对象。商标许可使用制度应从竞争法和消费者权益保护法角度平衡商标许可关系主体的权利,建立指导与约束并重的商标行政管理体制。From the existing judicial cases, trademark licensing dispute is no longer limited to licensing contract conflict, but also extended to the trademark competition order and protecting the interests of consumers trust. The former is governed by the contract law, the latter as the adjustment object of trademark law, trademark licensing system should equilibrate the relationship between trademark licensing stakeholders for the sake of competition right and consumer protection, then enrich the trademark administration with directive and restrictive institutional system.
