摘　　要：民法典正式实施后,现行的婚姻法、继承法、民法通则、收养法、担保法、合同法、物权法、侵权责任法、民法总则将同时废止。其中包含了关于票据质押相关内容的担保法和物权法都将废除,其相关的司法解释也将会废除,对应民法典的司法解释目前还无从获得,但从民法典改动的情况来看也不会在票据权利质押方面有很大的变化。因此本文将结合民法典、票据法及相关内容,比对不同法律及票据法内部的法律条文,指出票据的质押在立法上的矛盾,明确有质押背书的票据质押与票据权利质押的异同,提出完善票据质押与票据权利质押制度的建议。After the civil code is formally implemented, the current marriage law, inheritance law, general principles of civil law, adoption law, guarantee law, contract law, property law, tort liability law and general provisions of civil law will be abolished at the same time. The security law and property law, which contain the relevant contents of bill pledge, will be abolished, and the relevant judicial interpretation will also be abolished. At present, the judicial interpretation corresponding to the civil code has not been obtained, but from the situation of civil code changes, there will be no great changes in the pledge of bill rights. Therefore, this paper will combine the civil code, bill law and related contents, compare different laws and internal legal provisions of bill law, point out the contradiction of bill pledge in legislation, clarify the similarities and differences between bill pledge with pledge endorsement and bill right pledge, and put forward suggestions to improve the system of bill pledge and bill right pledge.
