摘　　要：近年来,网络短视频作为内容产业飞速发展的同时版权侵权问题也愈发严重。探析网络短视频平台的版权侵权责任对于遏制版权侵权、维护原创作品确有必要。作为网络服务提供者,网络短视频平台的责任同样适用现有法律规定,但存在着法律规定分散、避风港规则缺乏具体可操作性以及注意义务缺失等问题。针对上述问题,可以通过设立短视频平台责任相关条例、统一规范主观过错判定标准;完善避风港规则的具体操作规范;增设网络短视频平台的注意义务等,以此完善网络短视频平台版权侵权责任,遏制短视频侵权乱象,促进内容产业的良性健康发展。In recent years, with the rapid development of network short video as a content industry, the prob-lem of copyright infringement is becoming more and more serious. It is necessary to analyze the copyright infringement liability of network short video platform for curbing copyright infringement and maintaining original works. As a network service provider, the responsibility of network short video platform is also applicable to the existing legal provisions, but there are some problems, such as scattered legal provisions, lack of specific operability of safe haven rules and lack of duty of care. In view of the above problems, we can establish relevant regulations on the liability of short video platform, standardize the judgment standard of subjective fault, improve the specific operation standard of safe haven rules, and add the duty of care of network short video platform, so as to im-prove the liability of copyright infringement of network short video platform, curb the chaos of short video infringement, and promote the healthy development of content industry.
