摘　　要：我国举证时限制度遭受了前所未有的困境,证据失权制度对实体正义造成巨大冲击的背景下,为了缓和严格证据失权制度对实体正义的冲击,也为了保障诉讼效率,民事诉讼法实质上引入了为民事赔偿制度约束逾期举证行为。通过从诉讼后果和私法负担上双管齐下,更加合理地适用逾期举证的法律后果,对实践中出现的赔偿范围、赔偿程序等问题予以解决,细化与明确当事人因逾期举证而承担的赔偿责任,如采取增加律师费用来更好地发挥该制度对逾期举证行为的约束与威慑作用、明确双方的举证责任的分配,并且采用分层原则构建逾期举证赔偿制度。China’s time limit system of proof has been in an unprecedented predicament. Under the back-ground of the huge impact of the system of loss of evidence on substantive justice, in order to ease the impact of the strict system of loss of evidence on substantive justice, and to ensure the efficiency of litigation, the Civil Procedure Law essentially introduces the civil compensation system to restrict the overdue proof behavior. Through the two pronged approaches of litigation consequence and private law burden, we can apply the legal consequence of overdue proof more reasonably, solve the problems of compensation scope and compensation procedure in practice, refine and clarify the compensation liability of the parties due to overdue proof, such as increasing the lawyer’s fees to better play the restraint and deterrent role of the system on the overdue proof behavior and to en-sure the distribution of the burden of proof of both parties, and use the layered principle to build the system of compensation for overdue proof.
