摘　　要：片面共同正犯这一概念并没有明确的在我国刑法法条中出现并被准确定义,是否将片面共同正犯纳入我国共同犯罪理论体系之中,在理论体系中又应以何种方式认定,这个问题在我国刑法学界一直存在争议。本文基于客观主义行为共同说,支持片面共同正犯的成立,单向的意思联络也可以构成共同故意,加上片面共同正犯的行为与结果之间具备因果关系,主客观相统一,根据“部分实行、全部责任”原则,可以将不知情一方的犯罪结果的责任追及知情一方,以达到罪责刑相适应的目的。The concept of a one-sided joint principal offender has not clearly appeared in China’s criminal law and is not precisely defined. Whether to include a one-sided joint principal offender into our joint criminal theory system, and in what way should it be determined in the theoretical system, this question has been controversy in China’s criminal law community. This article, based on the joint objective theory of behavior, supports the establishment of a one-sided common offense. One-way intentional communication can also constitute a common intention. In addition, there is a causal relationship between the one-sided common offense and the result. The subjective and objective are unified. The principle of “Partial implementation, full responsibility” can be used to pursue the responsibility of the criminal result of the uninformed party to the informed party, so as to achieve the purpose of adapting the crime to punishment.
