摘  要:中国古代社会是一个注重等级秩序的封建社会,服饰通常被作为区别尊卑等级的重要标志,丧服便是其中一种。这种丧服制度又称五服制。在封建统治“亲亲”“尊尊”的思想下,五服制与法律结合起来,在儒家以礼入法,礼法结合的大背景下,“准五服以治罪”应运而生,成为封建统治政权的工具,该制度延续了两千多年,对维护封建君主专制制度和维护礼法结合的封建法制思想具有重要作用,本文拟通过对“准五服以治罪”的研究,阐述其主要内容、主要体现和主要作用,使大家对该制度有更深的了解。Ancient Chinese society is a feudal society that pays attention to the order of hierarchy. Clothing is usually regarded as an important symbol to distinguish the rank of superiority and inferiority. Mourning is one of them. This system of mourning is also called the five service system. Under the thought of “kinship” and “respect” of feudal rule, the combination of the five service system and the law, under the background of the combination of Confucianism and the law, the “quasi Wu Fu to punish crimes” came into being and became the tool of the feudal ruling power. The system lasted for more than 2000 years, and played an important role in maintaining the feudal legal system of the combination of the monarchy and the law. Through the study of “quasi Wu Fu to punish crimes”, this paper expounds its main content, main embodiment and main role, so that everyone has a deeper understanding of the system.
