摘 要:目前,公民违法犯罪信息与社会信用体系建设之间如何衔接,对已经受过刑罚处罚的信用主体如何适用失信惩戒等方面尚没有统一定论。二者有着本质的区别,但也有耦合部分。因此,我们不能将违法犯罪信息直接并入社会信用体系建设中。在对公民进行社会信用评价时,应当如何划归违法犯罪信息,是细化区分违法犯罪类型和犯罪目的,还是按社会危害性选择性地将违法犯罪信息纳入社会信用体系,亦或是附条件不纳入社会信用体系建设中,是应当细究的问题。我们要创新社会信用体系建设理念,细化社会信用体系建设的法律规定和制度建设,力求在保护法益与保障人权之间达到相对平衡。At present, there is no unified conclusion on how to link the information of citizen’s illegal crime with the construction of social credit system, and how to apply the punishment of trust-breaking to the subject of credit who has been punished. The two are fundamentally different, but also coupled. Therefore, we can not directly integrate criminal information into the construction of social credit system. When evaluating the social credit of citizens, how to classify the illegal and criminal information, whether to specify the types and purposes of the illegal and criminal crimes, or to selectively incorporate the illegal and criminal information into the social credit system according to the social harm, or not to incorporate the information into the construction of the social credit system with conditions, is a problem that should be investigated in detail. We should innovate the concept of social credit system construction, refine the legal provisions and institutional construction of social credit system construction, and strive to achieve a relative balance between the protection of the interests of the law and the protection of human rights.
