摘 要:我国平台经济正处于繁荣发展时期,并逐渐成为推动国民经济发展的主力军。但平台经济的快速发展的同时也暴露出我国在平台经济领域制度设置的不完善之处。尤其是在反垄断领域,中国知网、美团、阿里巴巴等互联网平台反垄断案件的频繁发生,反映出我国在平台经济领域反垄断监管的缺失。平台经济的巨大规模和影响力,使得垄断问题一旦发生,所造成的损害是难以估计且无法弥补的。而现行以事后规制为主的监管制度和反垄断法的相关规定,不能及时有效地解决垄断问题。因此,有必要在平台经济领域建立以包容审慎监管、适度干预、促进竞争鼓励创新为基本原则,以消极的动态监管为主要内容的事前监管制度。China’s platform economy is in a period of prosperous development, gradually becoming the main force to promote the development of the national economy. However, the rapid development of the platform economy also reveals the imperfections of the institutional setting in the platform economy in China. Especially in the field of anti-monopoly, the frequent occurrence of anti-monopoly cases of Internet platforms such as Cnki, Meituan and Alibaba reflects the lack of anti-monopoly supervision in China. The huge scale and influence of the platform economy makes the damage caused by monopoly problems, once they occur, difficult to estimate and irreparable. The current regulatory system and the relevant provisions of the anti-monopoly law cannot solve the monopoly problem in a timely and effective manner. Therefore, it is necessary to establish an ex ante regulatory system in the platform economy with the basic principles of inclusive and prudent regulation, moderate intervention, promoting competition and encouraging innovation, and negative dynamic regulation as the main content.
