摘 要:作为金融市场的基础设施,征信是现代社会的第二张身份证。随着进入信息化社会,征信业借助信息技术发展可以获取到海量的用户信息。但是,随之也产生了过度采集,信息采集错误,处理使用信息不当等问题,对个人隐私权的保护带来了障碍,侵害了信息主体的合法权益。本文以征信机构的征信行为为视角,分析信息社会下征信行为规制的现实困境,通过比较借鉴国外相关经验,提出规范征信行为的完善建议,以期有助于更好地保护信息主体的合法权益。As the infrastructure of financial market, credit investigation is the second ID card of modern society. With the introduction of information society, credit investigation industry can obtain massive user information with the help of information technology development. However, problems such as excessive collection, error of information collection, improper processing and use of information, etc. have also occurred, which have brought obstacles to the protection of personal privacy and infringed upon the legitimate rights and interests of information subjects. From the perspective of the credit investigation behavior of credit investigation agencies, this paper analyzes the realistic dilemma of the regulation of credit investigation behavior in the information society, and puts forward some suggestions to improve the regulation of credit investigation behavior through comparison and reference of relevant foreign experience, in order to help better protect the legitimate rights and interests of information subjects.
