摘　　要：中国传统法律文化凝结了中华民族五千年的智慧结晶,包含着我国古代的法律思想、法律观念以及各时代的法律制度,有着鲜活的历史印记和时代特点。在法治建社过程中,中国传统法律文化不仅发挥着积极作用,同时也产生了一定的消极影响。在现代法治体系建设中,我们应当辩证地看待这些影响,去粗取精,充分吸收传统法律观念的精髓,为良法善治注入生命力。The traditional Chinese legal culture has condensed the wisdom crystallization of the Chinese nation for five thousand years. It contains the ancient Chinese legal thoughts, legal concepts and legal systems of different times, with fresh historical marks and characteristics of The Times. In the process of building society by rule of law, the traditional Chinese legal culture not only plays a positive role, but also has a certain negative influence. In the construction of modern rule of law system, we should dialectically view these influences, remove the coarse and select the fine, fully absorb the essence of traditional legal concepts, and inject vitality into good law governance.
