摘　　要：在房地产限购政策、信贷政策、户口限制政策等的背景下,社会逐步产生了“借名买房”的社会问题,因此司法实践中对“借名买房”的认定在某种程度上可被视为一种法律政策上的缓兵之计。但是对于百姓来说住房具有很高的财产价值,在利益面前,一些家庭会因此而产生财产纠纷。现实中,结婚房产是非常重要的财产问题,而一些夫妻往往不具有购买资格或者是借用他人的名义购买房屋等等操作,但是夫妻离婚时,借名买房的房产往往成为离婚财产分割的焦点问题,司法实践在处理这些复杂的财产纠葛时,往往需要应对许多法律法规上没有明确规定的漏洞。基于此背景,本文通过夫妻之间的借名买房,夫妻借父母名义买房,父母借子女的名义买房(实际是对子女的赠予)几种常见的婚姻家庭中借名买房的进行分析,探析相关案件纠纷的解决思路。旨在为司法实践提供一个参考方向,合理的解决婚姻家庭中借名买房纠纷,化解社会矛盾。Against the backdrop of policies such as real estate purchase restrictions, credit policies, and household registration restrictions, the social problem of “buying a house by borrowing a name” has gradually emerged in society. Therefore, in judicial practice, the recognition of “buying a house by borrowing a name” can be seen to some extent as a legal policy delaying tactic. But for the people, housing has a high property value, and in the face of interests, some families may have property disputes as a result. In reality, marriage property is a very important property issue, and some couples often do not have the qualification to buy or borrow the name of others to buy housing and other operations, but when couples divorce, the property bought under a borrowed name often becomes the focus of divorce property division, judicial practice in dealing with these complex property entanglements, often need to deal with many laws and regulations on the loopholes that are not clearly defined. Based on this background, this paper analyzes several common cases of buying property in the name of a couple, buying property in the name of parents, and buying property in the name of children (which is actually a gift to children), and explores the ideas of solving disputes in related cases. The purpose is to provide a reference direction for judicial practice, to reasonably solve the dispute of buying a house in the name of marriage and family, and to resolve social conflicts.
