民事远程庭审证人在线作证制度之完善

摘　　要：随着互联网的不断发展,信息技术与司法程序逐渐融合,诉讼电子化已成必然趋势,远程庭审程序下在线作证便利证人和提高证人出庭比率的同时,对法官判断证人证言真实性产生一定程度的影响,弱化“情态证据”效应,不利于实现程序公正、保障当事人的程序权利等,为充分发挥证人在线作证的价值,有必要对证人在线作证制度进行反思:怎样缓解证人在线作证制度与庭审公开直播之间的冲突、保证证人在出庭作证之前不接触到庭审的相关材料;消除其对法官判断证据真实性的影响等。同时对证人在线作证制度进行完善:优化在线作证程序;构建“法院协助”证人在线作证模式;探索体系化的在线作证适用标准等,从而更好地保障当事人的合法权益,保证司法公正,保障远程庭审程序的正常运行。With the continuous development of the Internet and the gradual integration of information technology and judicial procedures, electronic proceedings have become an inevitable trend. Online testimony in remote trial procedures not only facilitates witnesses and improves the ratio of witnesses to appear in court, but also has a certain degree of influence on judges’ judgment of the authenticity of witness testimony. Weakening the effect of “modal evidence” is not conducive to the realization of procedural justice and the protection of procedural rights of the parties. In order to give full play to the value of online witness testimony, it is necessary to reflect on the system of online witness testimony: how to alleviate the conflict between online witness testimony system and public live broadcast of the trial, and ensure that witnesses do not have access to the relevant materials of the trial before testifying in court;eliminate its influence on the judge’s judgment of evidence authenticity and so on. At the same time to improve the system of online witness testimony: optimize the online testimony procedure;construct “court assistance” witness online testimony mode;explore the application standards of systematic online testimony, so as to better protect the legitimate rights and interests of the parties, ensure judicial justice, and ensure the normal operation of remote trial procedures.
