摘　　要：婚姻是男女双方在平等自愿的基础上建立的长期契约关系。民法典婚姻家庭编新增的离婚冷静期条款是在我国居高不下的离婚率的背景下制定的,是以程序拖延的方法,让离婚当事人将离婚纠纷暂时搁置,在法定的期限内冷静思考,等期限届满后再考虑是否离婚。在民法典编纂过程中也出现很多反对意见,如家庭暴力,虐待,不履行法定的抚养义务等风险加重。离婚冷静期需要慎重对待,首先保证不侵犯妇女,儿童,老人等权益,优化机制,对于不同的情况设置形式多样的措施。Marriage is a long-term contractual relationship between a man and a woman established on the basis of equality and voluntariness. The divorce cooling-off period newly added to the marriage and family code of the civil code was formulated against the background of the high divorce rate in our country. It is a method of procedural delay to allow the parties to the divorce to temporarily put aside the divorce dispute and think calmly within the statutory time limit. After the expiration of the time limit, consider whether to divorce. In the process of compiling the civil code, there are also many objections, such as increased risks of domestic violence, abuse, and non-fulfillment of statutory parenting obligations. The divorce cooling-off period needs to be treated with caution. First, ensure that the rights and interests of women, children, and the elderly are not violated, optimize the mechanism, and set up various measures for different situations.
