摘 要:地方性法规处于我国法律位阶的底端,是我国宪法、法律实施的重要形式,其数量庞大、内容繁杂,保障其合宪性是当下法治建设的基本要求,对其开展合宪性审查具有宪法和法律等规范依据。我国已经建立起对地方性法规多层次的合宪性审查制度,并且借助备案审查制度展开了相应实践。但现有地方性法规的合宪性审查制度存在着审查模式存在不足、审查机制缺乏刚性和审查合力尚未形成等弱点,应完善审查模式、构建刚性审查机制和发挥审查合力,采用具体与抽象审查相结合的方式,来有效推进我国合宪性审查工作,实现“依宪治国”,提升中国特色社会主义法治水平。Local laws and regulations are at the bottom of China’s legal hierarchy and are an important form of implementing the Constitution and laws of China. China has already established a multi-level constitutionality review system for local regulations, and has carried out corresponding practices with the help of the filing review system. However, the existing system of reviewing the constitutionality of local laws and regulations has weaknesses such as inadequate review mode, lack of rigidity in the review mechanism and uncooperative force in the review, etc. The review mode should be improved, rigid review mechanism should be constructed and cooperative force in the review should be brought into play, and a combination of concrete and abstract review should be adopted to effectively promote the review of constitutionality in China and realize the “rule by constitution”. This will enable us to effectively promote the review of constitutionality in China, realize the rule of law in accordance with the Constitution, and enhance the level of socialism with Chinese characteristics.
